Terms of Service
These Terms of Service (the "Terms") govern your access to and use of dripflicks.lol and any related sites or services operated by DripFlicks (collectively, the "Service"). By accessing or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least eighteen (18) years old, or the age of majority in your jurisdiction (whichever is higher), to use the Service. By using the Service you represent and warrant that you meet this requirement and that adult sexual material is lawful for you to access in your location. See our Age Verification Policy for jurisdiction-specific requirements.
2. Definitions
"Service" means the website dripflicks.lol and all features made available through it. "Source Platform" means a third-party platform from which we aggregate metadata and to which our video links point (currently xHamster, reached via the partner redirect xh.partners, and NuVid, reached via the partner redirect nvdvid.com; others may be added). "Content" means any video metadata, thumbnails, outbound video links, search terms, performer references, and editorial text shown on the Service. "User" means any natural person who accesses the Service.
3. Nature of the Service — aggregator
DripFlicks is an aggregator. We do not host, store, stream, or transmit any video files, and we operate no video player of any kind. We display video titles, thumbnails, and metadata only; clicking a video opens the video's page on the Source Platform (currently xHamster, reached via the partner redirect xh.partners, or NuVid, reached via the partner redirect nvdvid.com) in a new tab, and all playback, streaming, and player technology is operated by the Source Platform on its own website. The only data that touches our servers is metadata (title, thumbnail URL, duration, tags, the source platform's video-page URL). DripFlicks currently aggregates from xHamster (via the xHamster partner program) and NuVid (via the NuVid partner program). The architecture is built to ingest additional public sources (other content feeds, RSS feeds, and similar) in the future. Each new source is brought under the same compliance regime described on this site (acceptable-content policy, takedown procedures, age-verification expectations).
4. Licence to use
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and view the Service for personal, non-commercial purposes. All right, title, and interest in and to the Service, other than third-party content belonging to Source Platforms, remains with us.
5. Acceptable Use
Use of the Service is also governed by our Acceptable Use Policy and Acceptable Content Policy. Without limiting those, you shall not: (a) violate any law; (b) infringe any intellectual-property or other right; (c) attempt to scrape, mass-download, or programmatically access the Service except via documented endpoints; (d) circumvent technical protection measures; (e) impersonate any person; (f) submit malicious code; (g) harass or attempt to identify any other user.
6. Third-party content
The video files hosted and played on the Source Platforms' own websites are not under our control. We do not pre-screen, endorse, or vet such content beyond enforcing our Acceptable Content Policy on the metadata layer. You acknowledge that clicking a video takes you to the Source Platform's website in a new tab, and that you view such content there at your own risk and discretion. Liability for the underlying video lies with its producer and the hosting Source Platform.
7. Intellectual property
DripFlicks, the design, layout, source code, original copy, and selection and arrangement of content on the Service are our intellectual property or licensed to us. Trademarks, service marks, and logos of Source Platforms and producers shown on the Service are the property of their respective owners and used for identification purposes only, consistent with nominative fair use.
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION. WE DO NOT WARRANT THAT ANY LINKED CONTENT WILL BE AVAILABLE AT ANY TIME, AS SOURCE PLATFORMS MAY REMOVE OR RESTRICT CONTENT WITHOUT NOTICE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DRIPFLICKS, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US$100).
10. Indemnification
You agree to indemnify, defend, and hold harmless DripFlicks, its officers, agents, and employees from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) any content you submit, transmit, or display.
11. Termination
We may suspend or terminate your access to all or part of the Service at any time, with or without cause, and with or without notice. On termination, your right to use the Service ends; sections that by their nature should survive (IP, disclaimers, limitations, indemnification, dispute resolution) survive.
12. Governing law and venue
These Terms are governed by the laws of the operator's home jurisdiction, excluding conflict-of-laws principles. Subject to the dispute-resolution section below, exclusive jurisdiction lies with the competent courts in that jurisdiction. The specific jurisdiction will be identified here once the operating entity is registered; users who require this information sooner may request it at peterdgarrido@proton.me.
13. Dispute resolution
The parties shall first attempt good-faith informal resolution by written notice to peterdgarrido@proton.me. If unresolved after thirty (30) days, disputes shall be resolved by binding individual arbitration administered by a recognised arbitration body in the operator's home jurisdiction, in English, on the basis of these Terms. Either party may seek interim injunctive relief in court.
14. Class-action waiver
Disputes shall be brought in an individual capacity only, not as a plaintiff or class member in any purported class, consolidated, or representative action. This waiver does not apply where prohibited by applicable law.
15. Force majeure
We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, terrorism, civil unrest, government action, labour disputes, internet or telecommunications failures, third-party platform outages, or pandemics.
16. Assignment
You may not assign or transfer these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets without notice.
17. Severability and waiver
If any provision is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right.
18. Entire agreement
These Terms (together with the Privacy Policy and all policies referenced in them) constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
19. Changes
We may modify these Terms at any time by posting the revised version. The effective date will be updated. Material changes will be brought to the visitor's attention via a site-wide banner for at least 14 days after they take effect. Continued use after the effective date constitutes acceptance.
